Terms and Conditions of Use and Sale of the Website wavesacademie.com
This website offers both in-person and virtual courses on hand-tied hair extensions and includes an online store that allows users to order company products. This contract is a legal agreement between any user of the website (hereinafter the "User") and Waves Académie (hereinafter "Waves Académie"). If the User disagrees with these terms, they must immediately stop using the site.
In addition to the Terms of Use and Sale, the Privacy Policy applies to the use of the Site.
These Terms of Use and Sale are dynamic and subject to change at any time without notice. It is the User's responsibility to check for updates. Using the site after the Terms of Sale have been updated is considered acceptance of the modified Terms of Use and Sale.
1. Access to the Store
Access to the Waves Académie online store is restricted to professional hairstylists who have completed an authentication validation process. To make purchases, the User must provide proof of a hairstyling diploma and certification in a hand-tied extension method, whether obtained from Waves Académie or elsewhere. Additionally, hairstylists are required to install the extensions on their clients and may not resell the extensions without installing them.
2. Intellectual Property
The trademarks and logos used and displayed on the Site are the property of Waves Académie and Waves Extensions. It is prohibited to reproduce, in whole or in part, the trademarks, logos, images, and photos of the Site for commercial or advertising purposes.
All elements of the Site (including but not limited to infographics, images, photos, texts, articles, videos, illustrations, etc.) are subject to copyright and belong to Waves Académie or third parties producing its content. No element of the Site shall be interpreted as granting the User rights over the intellectual property of Waves Académie or any third party producing its content.
It is strictly forbidden to share access to the online course platform, reproduce, in whole or in part, the videos, or allow another person who has not purchased the course to view them. Downloading, publishing, or copying any element of the Site without prior written permission from Waves Académie is prohibited. We reserve the right to permanently ban any User from the platform without notice or refund if we detect practices that violate our terms and conditions.
3. Disclaimer and Limitation of Liability
The Site, its content, services, and products are presented as-is, without any implicit or explicit warranties. Despite significant efforts by Waves Académie to keep the Site up to date, the information may contain inaccuracies or errors, including pricing errors. Waves Académie and its subsidiaries do not guarantee the accuracy of the information displayed on the Site and disclaim any responsibility for inaccuracies or errors related to it.
Without limiting the generality of the above, under no circumstances shall Waves Académie, its subsidiaries, and/or its suppliers be liable for direct, indirect, punitive, incidental, special, or consequential damages arising from or in any way related to the User's access, display, or use of the Site, regardless of the cause, even if Waves Académie, its subsidiaries, and/or its suppliers have been advised of the possibility of such damages.
4. External Links
Hyperlinks on this Site may lead to third-party sites. These sites are not under the control of Waves Académie, and it cannot be held responsible for their content or hyperlinks. The accessibility of a site from a hyperlink on the Site or on Waves Académie's Facebook or Instagram pages does not imply any endorsement or partnership.
5. Applicable Laws
These terms of sale are governed by the laws of the province of Quebec and applicable Canadian laws and must be interpreted accordingly. Any dispute must be submitted to a competent court in the judicial district of Quebec, province of Quebec. If any provision of these terms of sale is illegal, void, or unenforceable, it shall be deemed unwritten without restricting the scope of the other provisions.
The terms of sale and any other legal notices or statements appearing on the Site constitute the entire agreement between Waves Académie and the User regarding the use of the Site and its content.
7. Right to Refuse and Cancel Orders
Waves Académie has the sole discretion to refuse or cancel any order and/or limit the quantities ordered for any reason. Waves Académie may also request additional information before processing any order.
Reasons for refusal and cancellation of an order may include, but are not limited to: out-of-stock items, product unavailability, incorrect billing information, orders intended for resale, suspicious or potentially fraudulent orders, typographical, pricing, or information errors on the Site, etc.
Waves Académie commits to refunding any order canceled after billing.
8. Returns
Products purchased from the Waves Académie online store are final sale and cannot be refunded, except in the case of defects or an error on our part in your order. If applicable, please email us at stephanie.simard18@gmail.com within 30 days of your order with a photo of the product in question and your contact information (full name and phone number). A member of our customer service team will get back to you as soon as possible to validate your request and proceed with a refund or replacement of the defective or incorrect product.
Waves Académie's online and in-person training programs are non-exchangeable, non-refundable, and non-transferable.
In case of conditions beyond our control - lockdowns related to the pandemic or any other force majeure - the course will be postponed to a later date.
